IWA Welcomes First-Time Recognition of Co-working Spaces Under GST Registration Framework

BusinessManasi Praharaj04 Nov 2026

04th November 2026: The Indian Workspace Association (IWA), an industry body representing India's co-working and flexible workspace sector, welcomes the Central Board of Indirect Taxes and Customs' (CBIC) revised GST registration guidelines, which, for the first time, recognise co-working spaces as a distinct category of business premises for GST registration. Established by six founding trustees - WeWork India, Awfis, Smartworks, Innov8, Incuspaze and Simpliwork, IWA serves as a unified voice for the sector, advocating for industry recognition and regulatory clarity. The guidelines, issued through Circular No. 257/03/2026-GST, dated October 26, 2026, following the 57th GST Council meeting, mark a significant milestone for the industry, addressing a longstanding regulatory challenge and bringing greater recognition to flexible workspace models within India's regulatory framework.

Previously, businesses operating from co-working spaces often faced challenges obtaining GST registration using membership agreements as proof of their business address. The revised guidelines specifically identify co-working spaces within the documentation requirements for GST registration, acknowledging membership agreements as part of the prescribed proof of business premises. The GST registration portal also now includes specific provisions for co-working spaces, allowing applicants to upload membership agreements and provide the GSTIN of the workspace provider. This recognition represents an important shift in how co-working premises are treated for GST registration, bringing greater certainty to both workspace operators and the businesses they serve.

The development follows sustained industry engagement by IWA and its members with central and state government authorities to address regulatory challenges faced by the sector. The Association is grateful for the government's constructive engagement and its efforts to align regulatory processes with evolving business and workplace models.

Karan Virwani, Chairman, IWA, and MD & CEO, WeWork India, said, "We welcome the GST Council's decision to recognise co-working and shared workspaces for GST registration. This is an important milestone for India's flexible workspace industry, bringing regulatory recognition in line with the evolving ways in which businesses operate and grow. The recognition of membership agreements as valid documentation for GST registration is particularly significant, as it addresses a longstanding challenge for businesses operating from shared workspaces. For startups, MSMEs, and enterprises expanding across markets, this brings greater clarity and simplifies the process of establishing a compliant business presence. Beyond easing compliance, this development reinforces the role of flexible workspaces in enabling entrepreneurship, business expansion, and economic growth. On behalf of the Indian Workspace Association, we thank the GST Council, the Ministry of Finance and CBIC for taking this important step towards a more inclusive and business-friendly regulatory framework."

Amit Ramani, Secretary, IWA, and CMD, Awfis, said, "For businesses choosing flexible workspaces, regulatory clarity is as important as operational flexibility. The absence of clearly defined documentation requirements often created uncertainty during GST registration, despite businesses operating from legitimate commercial premises. These guidelines help bridge that gap by recognising how modern workplaces function. From startups to large enterprises, this means greater confidence in establishing operations, entering new markets and scaling their presence without unnecessary administrative hurdles. We thank all stakeholders for their engagement with the industry and for a decision that will make the sector easier to scale and easier to trust.”

Harsh Binani, Treasurer, IWA, and Co-Founder, Smartworks said, "As more enterprises turn to flexible workspaces to establish and expand their operations across India, it is important that regulatory frameworks keep pace with changing business needs. This development is a welcome step towards bringing greater clarity and certainty to a segment that is increasingly becoming an integral part of India's business infrastructure. It will give businesses greater confidence to adopt flexible workspace models as they enter new markets and scale their operations. We appreciate the government's continued efforts to create a business-friendly regulatory environment that supports enterprise growth and investment."

Beyond resolving a longstanding regulatory challenge, this development is an important step towards strengthening the flexible workspace industry's position as an integral part of India's business infrastructure. Greater regulatory certainty can encourage wider adoption, strengthen confidence among businesses and support the sector's continued expansion. Building on this milestone, IWA remains committed to working closely with government authorities, policymakers and industry stakeholders to advance policy reforms that enable the industry's long-term growth and strengthen its contribution to India's economic development.
